Do you rely on H2B and H2A rulings for managing your labor force? This new rule could benefit you. According to the American Nursery and Landscape Association, the Department of Homeland Security is issuing certain waivers for undocumented workers to stay in the U.S. if they are related to citizens, and are here physically yet unlawfully.
These are called “Provisional Unlawful Presence Waivers” and the applicant has to demonstrate that there would be “extreme hardship” due to the separation of the undocumented worker from their U.S. citizen-relative.
